Terms of Service
IMPORTANT NOTICE: These terms are an unreviewed draft. They are provided “as is” and without warranties, and are not yet a valid legal agreement.
1. Acceptance of Terms
By using DC's Pro-Spect (“the Service”), you agree to be bound by these Terms of Service (“Terms”) once they are finalized. If you do not agree, you may not use the Service.
2. What This Service Is
DC's Pro-Spect measures, films, and photographs athletes preparing for college recruiting, and delivers a package of that material to the family. Registration, check-in, and consent for a capture session happen at the facility, in person.
3. Eligibility & Consent
Capture sessions routinely involve minors. Consent to film or photograph an athlete is obtained by the facility, at the time of a specific session, using the facility's own consent form. It applies to that session only and does not carry forward to a later visit.
- An athlete cannot be assigned an event number for a session without recorded consent to be filmed or photographed for that session.
- Nothing captured of an athlete is published or made public without a separate, recorded consent specifically permitting public publication.
- A parent or legal guardian must give this consent. We do not accept consent from anyone else on a minor athlete's behalf.
4. The Athlete's Package
A family that completes a capture session leaves with a package of their athlete's measurements and media, which they own. [TBD] the exact scope of what “owns” means here (for example, whether DC Sports may also retain or use a copy) has not been finalized and needs legal review before this section is treated as final.
5. Fees & Payments
[TBD] Pricing and payment terms for DC Sports have not been finalized and are not published here. This section will be completed once pricing is set.
6. Acceptable Use Policy
You agree not to misuse the Service. Prohibited actions include, but are not limited to:
- Uploading or transmitting abusive, defamatory, or unlawful content;
- Providing another person's personal data without their authorization;
- Attempting to breach, bypass, or test the vulnerability of our security systems, or accessing data belonging to another family or athlete.
7. Limitation of Liability & "As-Is" Warranty
No Warranty: The Service is provided on an “AS IS” and “AS AVAILABLE” basis. We disclaim all warranties of any kind, explicit or implied.
Limitation: To the maximum extent permitted by law, DC's Pro-Spect and its operators shall not be liable for any indirect, incidental, special, or consequential damages, including, without limitation, damages for lost data or missed communications.
